2. Data We Collect

We collect personal data including: name and contact details; CV, employment history and qualifications; diversity monitoring data (where voluntarily provided); right-to-work documentation; DBS disclosure numbers; National Insurance numbers for payroll; bank details where we pay you directly.

3. Lawful Basis

We process your data under the following lawful bases: Contract (to fulfil a recruitment engagement); Legitimate Interests (to match candidates to suitable roles); Legal Obligation (DBS, RTW and IR35 compliance); Consent (marketing communications).

4. Data Sharing

We share your data only with: prospective employers (with your consent); our payroll bureau; our background screening partner; regulatory authorities when legally required. We do not sell your data to third parties.

5. Retention

Candidate data is retained for 6 years from the date of last placement or last meaningful contact. Marketing consent records are retained for 3 years.

6. Your Rights

Under UK GDPR you have the right to: access, rectification, erasure, restriction, portability, and to object to processing. Contact our DPO at dpo@civictalent.co.uk. You also have the right to lodge a complaint with the ICO at ico.org.uk.

7. Transfers Outside the UK

We do not routinely transfer personal data outside the United Kingdom. Where any transfer is necessary, we ensure adequate safeguards via UK Adequacy Decisions or Standard Contractual Clauses.

What Are Cookies

Our Commitment

Our Business

We are a specialist recruitment consultancy operating solely in the UK public sector. Our supply chain consists primarily of technology, professional services and payroll providers, all of whom are based in the UK or EU.

Due Diligence

We conduct right-to-work checks on all candidates placed and require all suppliers to confirm compliance with the Modern Slavery Act. Our candidate screening process includes checks designed to identify indicators of exploitation or coercion.

Policies and Training

All CivicTalent employees receive annual training on identifying signs of modern slavery. Our HR and Compliance policies include explicit modern slavery provisions. We operate a confidential whistleblowing hotline for staff and suppliers.

Policy Statement

Our Obligations as a Recruiter

Anonymised Shortlisting

We offer anonymised CV shortlisting to all public sector clients, removing names, genders and addresses before submission to hiring managers, in line with Cabinet Office guidance on bias-free recruitment.

Reasonable Adjustments

We are committed to making reasonable adjustments throughout the recruitment process for candidates who disclose a disability or health condition. Please notify your consultant at any stage and we will work with you and the employer to ensure accessibility.

Gender Pay Gap

Our gender pay gap report is published annually on the government's gender pay gap service and on our website. We are committed to reducing any gaps identified through targeted recruitment and development programmes.

IR35 in the Public Sector

The off-payroll working rules (commonly known as IR35) have applied to public sector engagements since April 2017 under Chapter 10 of ITEPA 2003. As the fee-payer in most of our supply chains, CivicTalent Recruitment Ltd has obligations under these rules.

Status Determination

All public sector client engagements where CivicTalent acts as the agency are subject to a Status Determination Statement (SDS) prepared by the end-client using HMRC's CEST tool or an equivalent assessment. We record all SDSs and make them available to contractors on request.

Inside IR35 Engagements

Where a role is determined to be inside IR35, CivicTalent will operate PAYE on all payments made to the contractor's Personal Service Company (PSC) or direct to the individual. We deduct Income Tax and National Insurance at source and provide payslips for every payment run.

Outside IR35 Engagements

Where a role is genuinely outside IR35 and the client has issued an SDS to that effect, we pay the contractor's PSC gross of Tax and NIC. The contractor remains responsible for their own tax affairs.

Disagreement Process

Contractors who disagree with an SDS determination have the right to raise this with the end client. We will support this process and provide relevant documentation within 5 working days of request.
